This document is a public offer of the individual entrepreneur Ivan Konstantinovich Poberezhniuk (TIN (INN) 381206589662, Irkutsk, Russian Federation; the “Rightholder”) to enter into an agreement granting a simple (non-exclusive) licence to use the computer program “RageTun” on the terms set out below.
Under art. 437(2) of the Civil Code of the Russian Federation, this offer is addressed to an indefinite range of persons. Payment for the licence constitutes acceptance of the offer (full and unconditional acceptance of its terms) under art. 438(3) of the Civil Code. From the moment of acceptance the agreement is deemed concluded on the terms of this offer.
Program — the computer program “RageTun”, a network manager for Windows that routes network traffic on the User’s device. Licence — the right to use the Program’s extended features (the Pro plan) for the scope and term of the paid plan. User — the person who has accepted the offer. Licence key — a unique sequence that activates the Licence.
2.1. The Rightholder grants the User a simple (non-exclusive) licence to use the Program’s extended features (the Pro plan) for the term of the paid plan: 1 (one) month or 12 (twelve) months from the date of payment.
2.2. The Program’s basic features (the Free plan) are provided free of charge and are not restricted by this offer. On first installation the Program may provide trial access to the Pro features for 7 (seven) days (the “trial period”).
2.3. The Program is provided “as is”. The Rightholder does not warrant that the Program will operate without errors; the Program is in active development (beta).
2.4. RageTun is a client program for traffic routing and does not provide access to any servers or networks. The User configures connections (including server addresses and access parameters) independently, using their own data. The Rightholder does not provide communication services and does not provide access to any third-party resources.
3.1. Licence price: 299 (two hundred and ninety-nine) roubles for 1 month, or 2,490 (two thousand four hundred and ninety) roubles for 12 months. Prices are in Russian roubles; VAT is not charged (professional-income tax applies).
3.2. Payment is made by bank card through the payment service YooKassa (YooMoney LLC). A fiscal receipt under Federal Law 54-FZ is issued by the payment service.
3.3. Procedure: the User selects a plan on the website and pays; after payment is confirmed the licence key is shown to the User on the payment page. The key is provided immediately after the payment service confirms payment (usually within a few minutes). The payment description contains a link to retrieve the key again.
3.4. Registration and provision of personal data are not required to purchase. We recommend saving the licence key after payment. If the key is lost, it can be recovered on the website by the payment number (shown in the payment description in your banking app) for a few days after payment, or by contacting support.
4.1. The User may use the Program within the paid plan on the number of devices set by the plan (by default — one device; other devices on the User’s network gain access through the route-sharing feature).
4.2. The User may not modify or decompile the Program, circumvent licensing mechanisms, or transfer the key to third parties for resale.
4.3. The User undertakes to use the Program in accordance with applicable law and bears sole responsibility for the purposes and means of its use.
4.4. The Rights Holder may extend the licence or trial term free of charge (bonus days) — including under the referral program and promotions. Bonus days are not a standalone service, have no monetary value, are non-refundable and are not taken into account in refunds. The Rights Holder may change the accrual terms and revoke days accrued in violation of them (in particular, in cases of artificial farming).
5.1. The licence key is a result of intellectual activity (a licence to the Program) provided in digital form. As a general rule, a licence of proper quality is not subject to return or exchange after activation (start of use). This provision does not limit the User’s rights under clauses 5.2 and 5.3 and under consumer-protection law.
5.2. If the licence key has not been activated (has not been used to activate Pro on any device), the User may withdraw from the agreement and claim a refund within 14 (fourteen) days of payment by contacting support and stating the payment number (from the payment description or the fiscal receipt). Activation is verified against the licensing service’s records.
5.3. If defects in the Program are found (improper quality), the User may demand free removal of the defects, a proportionate price reduction, replacement, or withdrawal from the agreement with a refund, in accordance with the Russian Federation Law “On Protection of Consumer Rights”.
5.4. Refunds are made by the same method used for payment, within no more than 10 (ten) business days of receiving the request.
6.1. As the Program is provided “as is”, the Rightholder is not liable for any losses arising from the use of, or inability to use, the Program, to the extent permitted by applicable law.
6.2. The Rightholder’s aggregate liability is limited to the price of the paid Licence.
